the portals operated by AIKIT RESEARCH, S.A. This Legal Notice applies to all of them unless expressly stated otherwise.

Main activity:

artificial intelligence research laboratory (Spanish activity code CNAE 7210). Development and commercialisation of the AiKit platform, an artificial intelligence SaaS service aimed at small businesses and self-employed professionals. In addition, AIKIT RESEARCH manages advice on and the processing of public grant programmes for digital transformation with AI.

2. Purpose and acceptance

This Legal Notice governs the access to, browsing of and use of the websites operated by AIKIT RESEARCH, S.A. (hereinafter, «the Portals»).

Accessing the Portals confers the status of user (hereinafter, the «User») and implies full acceptance of all the provisions contained in this Legal Notice in the version published at the time of access.

Access to the Portals is free of charge, without prejudice to the cost of connecting to the telecommunications network. Contracting the services of AIKIT RESEARCH, S.A. is governed by:

• For the Nodu SaaS platform: the Platform Terms of Use and, where applicable, the Data Processing Agreement (DPA).
• For the Plan IA Empresarial campaign: the Plan IA Empresarial 2025 Terms and, where applicable, the Terms of the AIKIT GRANT SERVICES end-to-end management service.

These specific documents are available on the corresponding portal.

3. Intellectual and industrial property

All the contents of the Portals, including texts, images, graphic design, source code, logos, trade marks (such as «Nodu») and other elements, are the property of AIKIT RESEARCH, S.A. or of third parties who have authorised their use, and are protected by Spanish and European Union legislation on intellectual and industrial property.

Accessing the Portals does not grant the User any right of exploitation over those contents. Their reproduction, distribution, public communication, transformation or any other form of exploitation without the express written authorisation of AIKIT RESEARCH, S.A. is prohibited.

4. User obligations

The User undertakes to make correct use of the Portals in accordance with the law, this Legal Notice and good practice. In particular, the User undertakes to:

• Not use the Portals for unlawful purposes or purposes harmful to the rights and interests of AIKIT RESEARCH, S.A. or of third parties.
• Not reproduce, copy, distribute, publicly communicate, transform or modify the contents of the Portals without express authorisation.
• Not introduce or spread computer viruses or any other system that may cause damage to the systems of AIKIT RESEARCH, S.A. or of third parties.

5. Exclusion of warranties and liability

5.1. Regarding the information: the contents of the Portals are general and informative in nature. They do not under any circumstances constitute professional, technical, legal or financial advice. AIKIT RESEARCH, S.A. accepts no responsibility for decisions taken on the basis of the information provided on the Portals.

5.2. Regarding availability and continuity: AIKIT RESEARCH, S.A. does not guarantee the availability or continuity of access to the Portals, nor the absence of viruses or other harmful elements. It is for the User to have appropriate tools for their own protection.

5.3. Regarding third-party links: the Portals may include links to third-party websites. AIKIT RESEARCH, S.A. shall not be liable for the contents or the services supplied on those linked sites (art. 17 LSSI-CE).

6. Protection of personal data

The processing of personal data collected through the Portals is governed by our Privacy Policy. Contracting the Nodu SaaS platform is additionally subject to the Data Processing Agreement (DPA). The management of public grants is subject to the Plan IA Empresarial 2025 Terms and to those of AIKIT GRANT SERVICES. All of these documents are available on the Portals.

7. Applicable regulations

This Portal is governed by the following regulations, among others:

• Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE).
• Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR).
• Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD).
• Regulation (EU) 2024/1689 of the European Parliament and of the Council laying down harmonised rules on artificial intelligence (the AI Act).

8. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. For any dispute arising from the access to or use of the Portals, the parties submit to the jurisdiction of the Courts and Tribunals of the city of Madrid, with express waiver of any other jurisdiction that might apply to them.

This submission to jurisdiction shall not apply where the User has the legal status of a consumer, in which case the courts of their domicile shall have jurisdiction.
